Does limited common area include skylight?


Question:

Would "limited common areas" include skylight hatches, which afford the only access to HVAC units on the roof? In our 13-unit condo bldg., only four owners have this roof access. The condo association designed and installed these troublesome hatches without consulting the four owners re design or style. Owners apparently have liability if workers or other owners are injured on stairs leading to skylight-hatches or with regard to hatches themselves. We would like to define "limited" or "restricted common areas" attuned to the 21st century. Any suggestions, or sample language, will be most appreciated. (Our lawyer, since fired, proved no help. Our condo docs don't even mention the topic.)  Washington DC.
