Florida board member also on advisory board gets a double vote


Question:

double-votingOur HOA Board is made up of 3 members. The Board has established an ARB committee comprised of up to 5 members, in accordance with the bylaws.

My concern is that one of the Board members is also on the ARB committee. Our bylaws speaks nothing of this situation.

I find that dual membership is illegal because the board reviews all matters decided by the ARB for final approval. Therefore, the dual Board member gets to vote twice on issues decided by the ARB.

Unable to find any direction from Section 720. Feedback would be appreciated.
