HOA fee gap increasing between two and three bedrooms

HOA fees were established for two bedrooms and three bedrooms which are slightly different in size.  A factor for the different square footage is applied each year for all costs even though the cost does not have a nexus to the size of the unit. For example, cable service is provided to all units at the same price per unit. However, since the bill is paid in bulk to the company the HOA charges a greater price for the three bedrooms. Because the factor is included every year the differential in the fees for three bedrooms and two bedrooms has grown from about $6 per month to over $50 per month. I seem to recall a ruling about there must be a nexus. Obviously, there is no nexus for the different charge for cable for two or three bedrooms. Is this legal?
