HOA president took funds without consent


Question:

Our condo president decided to obtain an attorney to respond to a formal complaint made against another unit owner. The complaint was a consistent and excessive noise issues coming from that unit.

The complaining unit was unaware that they choose to get legal counsel and the was not informed of a decision for over 3 months. The advice of their legal counsel was to do nothing. At that point the complaining unit owner obtained her own legal counsel to intervene.

Almost 6 months later the issue has still not been addressed properly. I am the treasurer for the building and the complaining unit owner. Enjoying the condo association books for the month of August I realized that the president had taken $880 out of the HOA checking account to pay for the legal fees that she chose to incur.

I have repeatedly told her to pay this money back as it disrupts our ability to pay with the HOA checking account is designated to pay for the budget, the bylaws, and to keep the building maintenance and ability to put funds in reserves monthly from being accomplished.

she refuses to replace the money and instead chooses to bury her head in the sand and act as if the problem it does not exist. At no time or any meetings held regarding this or votes as well as the fact that no formal correspondence sent out via email or any other avenue.

I have filed charges against her with our local police department. Well the police said it was important I document this on paper and file this report against her they said the case would be closed as it is a condo association matter and needs to be dealt with through attorneys at this point. The condo association president and the owners of the unit that were complained against make up the rest of the board and are very close friends so there has been a clear bias from day one. What are my next steps in order to get the funds replaced by her.
