How to handle unit repair from a shifting building foundation?


Question:

If you take the HOA to court on the foundation movement causing damages to your unit and the insurance companies structural engineers report said it was from when the place was built and my lawyer didn't get a structural engineer to refute the other sides engineer and the board says they aren't going to repair the foundation and we want to settle. Can I sue the association again for the foundation movement because they own the foundation? I did get a structural engineer that agrees with me on foundation needing stabilizing from up and down movement. I have pictures showing damages that open and close with the weather and a huge crack in the slab that in 2016 was a closed crack and in 2019 when the insurance companies engineer came out it was opened up and sloping toward the entry door causing the door to stick. I do know insurance company engineers are biased and only give their opinions and would need to go to trial and hope the bad lawyer I got can show the jury that the engineer's report is biased and does show sloping of the foundation.

I have a big bow in the first-floor ceiling and the entry door problems with two big bumps in my second floor which is very noticeable and the crown molding closes and opens with movement of the foundation during different seasons...Ohio
