Insurance will not cover homeowner water damage

I am in a pickle. My insurance denied my claim because leaks are covered if accidental not caused by wear and tear. The toilet upstairs leaked and the ceiling in my bathroom and a common wall have been wet for two weeks now. The insurance from upstairs neighbor denied my claim because it was not negligence. What can I do to the insurance companies to pay?
