I live in Maryland and was wondering if there should be a standardized procedure for bylaw changes. I know that I have to find my specific bylaws for this and I have read the Maryland condominium act...
Long story short, a bylaw change was proposed and the information was mailed and hidden behind other documents. Although legally they followed MD law, many missed it. Then the board president went on a blitz campaign, door to door, pressured people to sign in favor of the change but told many lies about the need to sign.
Further, there was no document allowing us to vote "against" the changes. Many people wrote on their proxy that they were signing this to vote against- if is a proxy can they still vote for it if somebody hand-wrote they were against this? How long are proxies valid? Was a fiduciary duty violated by lying about the reasons to vote for it?
