Legal logic protecting HOAs from an existing owner claim

With respect to Reserves, what is the legal logic that protects the HOA from a claim by an existing owner to part of the Reserves? Here is a scenario: the HOA does a $5000 special assessment per owner to bulk up Reserves; an owner sells the following year.
