We are a new Board. The last member of the previous board resigned in May of this year. Being the Treasurer I’m having a debate on Assessment vs. Special Assessment. I need someone who can interpret the portion of our covenants that addresses both. We have a problem with erosion in our common areas, and undercutting in our stormwater ponds. I feel it’s an assessment, (when reading the covenant), whereas another board member feels it’s a special assessment. A special assessment in our covenants is defined as capital improvements. Therefore I need a second opinion from anybody.
