One owner of 2-unit condo is delinquent with repairs needed

Massachusetts. I am sole Trustee for a 2 unit condo. Other unit owner has abandoned all duties for years including payment of monthly condo fees. He has refused to pay for special assessment of roof for years. We are collecting and it will likely move to foreclosure. Roof is urgent. I was going to get an injunction to force him to immediately pay 1/2 of roof. What do you think? We need it before winter because water is entering.
