I am an owner within an HOA community and wondering the best course for filing suit against an HOA for a failure to complete or initiate structural repairs, after 3 requests over the past 6 years, that have caused the interior of my condo to slant, considerably.
As of 3 months ago, a contractor was sent to look at the repairs after we sent a demand letter, outlining the structural damage and number of requests made to repair. To date, the repairs have yet to be completed. Yesterday another contractor came to inspect the property and indicated that his repair would only stop future damage, but would not rectify damages sustained inside my unit and suggested that I place new flooring to unleveled floors, slanted doorways and significant cracks inside the unit due to their failure to repair from the initial request made 6 yrs ago, with updated requests following.
So, it is my responsibility to incur the costs from their negligence in repairing structural problems (outside the unit) that have now turned to more significant problems inside my unit?
