We have a problem that never came up before. A potential buyer wants to "babyproof" the balconies of the unit they wish to buy by covering and possibly extending the height of he balcony railings on the unit. The balconies are considered common area even though they are accessible to and used only by the unit owner. We have rules that bar changes to the outside of the units, including the balconies. Not only do the buyers want permission to make the changes, they insist that the HOA should pay for it. Has anyone had this situation come up before? The owner is threatening legal action if the sale fails. We are a small townhouse condo complex in California.
