Condo Q&A

Condo association member forced to pay roof leak damage herself

Written by CondoAssociation.com | Fri, May 7, 2010 @ 10:32 AM
The roof leaked into my condo. The condo association advised me they would pay for the damage and I needed 3 estimates. The contractors I contacted could not come out within the time period agreed I agreed upon with the property management company. I sent an e-mail to the management company that day asking for some of their contractors. I did not hear from them, and one month later I received a letter from a lawyer telling me I had to get this fixed by a date in the letter or the condo board would not pay for it. I am now being charged for the lawyer fee. (With that I had my insurance co appraise the damage).

I do not think I should pay this legal fee because I was within the dates agreed upon. I do not see anything in the rules or condo association bylaws saying I have to pay this. When I asked the management co, for a ByLaw that shows I need to pay this, they tell me it is up to the board. I have sent many e-mails and called the management co. plus left a voice message for the owner of the management company. No one on the board of directors have spoken with me about this at all. I have only been dealing with the management co. What can I do?
