Can anyone clear this up for me. I had a problem with a horrible leak in my kitchen that ruined cabinets, the wood floor, counter top, etc. I received a letter from the condo attorney telling me there was no coverage through the condo's insurance. I was also told by the claim person that works for the insurance company that there was no coverage.
About 2 weeks ago I received a letter from the management company offering me about 1/4 of what it would take to fix my kitchen and they want me to sign something saying I will not hold the association responsible for anything extra. The forms with all the prices was on the claim person's letterhead who came to see the damage. There was so much left out that I am sure this was not prepared by the person who came to my home but possible the management company filled it out on letterhead they got from the claim person. They didn't send me anything they received from the insurance company so I have no way of knowing what they are offering is the true amount that was paid out. I was amazed that the insurance company paid out the claim because a day before I got the letter in the mail from the management company, the claims worker at the insurance company told me in an email that nothing was covered. The next day I find out they paid out for that claim a while ago.
Something seems really wrong about this claim being paid because I didn't receive anything and now I am being offered a very small amount that wouldn't repair even the cabinets not less the floor, courter top, ruined items, etc. Since the amount they offered was so very small I tried to find out from the insurance company what was paid out but no one will tell me and they said they couldn't which I do not believe. Why wouldn't the insurance company want to make sure I am getting the amount they paid out? By not telling me is just opening the door for the management company to give me whatever they want because there is no way of checking this. I have been harassed for years by this management company with fake fines, a fake lien for items that were never received, a fake summons which cost the association a few thousands of dollars because the lawyer went to court twice and now everything was dropped because the judge was waiting for a letter from us asking him to dismiss the summons so the lawyer did it before I got a chance to. Because of the above and a lot more that many of you would have a hard time believing I don't trust this management company and think there is something going on between the management & the board as money is spent for no reason and no board would do this unless they didn't have to pay all the assessments the management company says we owe. One contractor who worked on our condos told me what he charged to do something and when I got the year end summary, I found there was a $17,500 profit on the price the contractor said he charged and what the management company charged us. This management company also replaced items that didn't need to be replaced in our condos causing us a large expense for no reason so I would not doubt if the insurance claim was just another way for them to possibly profit. Does an insurance company have the right to not tell me the person whose condo had the leak what was paid out for that leak? By not telling me allows the management company to pay out whatever they want and not what they received from the insurance company. I have a funny feeling they were trying to get away without paying out anything at all but someone got scared along the way. Thank you for reading this.
