How Do You Assign Financial Responsibility For Water Damage?


Question:

A unit in our HOA building suffered some water damage when the toilet in the unit above leaked. When the plumbers came to repair the problem, the discovered several small leaks in the water pipes that run through the floors. If the damage was caused solely by the leaking toilet, the owner would be liable. If the damage was caused solely by leaking pipes, then the HOA would be responsible. Since we cannot determine exact responsibility, how do we determine who should pay for the damages? We are thinking 80% HOA and 20% owner.
