Termites! Who is responsible for damage?

This question is submitted by Michelle M. out of San Diego, Ca

found termite swarm in my third floor bathroom condo two days ago. This should be the dry wood termite. I can see some termite coming from the air vent in the bathroom. I contacted our HOA for help. I got a message saying since the termites are in the condo. They are unsure who is responsible for fixing the problem. Am I responsible for the termite problem in my condo?
