The board is considering charging every unit the same monthly fee

This question is submitted by Kate S. out of Florida

I live in a 49-unit, 55-plus condo. All units pay monthly HOA fees according to the square footage of each individual unit. The board recently mentioned in a meeting they are considering charging every unit the same monthly fee. This means 1000 sq ft units will have to begin paying the same as 1500 sq ft condos. Is this legal?
