Who is responsible for cracked sub floors?

Question:

cracked-condo-subfloor.jpgI live on the second floor of a condo building in Wisconsin.

We had engineered hardwood and carpeting in the condo. We decided to change it to a laminate or hardwood. When the old floors were removed, the flooring installer walked off the job as the sub flooring, which is poured gypcrete over wood, was crumbling, cracked and had dips in it.

We need the floor leveled. Is this my responsibility, or should the condo association pay for it?
