Who pays for street lighting in new phase of HOA community?


Question:

Our Florida HOA community is still under construction.  Who pays for the new street lights being installed in new areas or phases.  The community is only about 55% built out. The developer and/or builder is charging this back to the HOA operating account for the homeowners to pay.  Is this correct? They say it is, because they have deeded all the common areas over to the HOA. Is this correct? I thought the common areas get deeded over to the HOA when the transition takes place and not before. If this is the case, did the transition not start by them deeding all common areas over to the HOA?
