Who should fix condo leak caused by building?

I recently had a leak caused by a common area kitchen stack backup. The HOA insurance determined that the subfloor got wet but was 4 inches beneath my travertine. Our CC&R's state bare walls policy. I wanted to determine who's responsible for my floors since this was a common area leak and they needed to remove my floors to dry out the subfloor but my floors were not ruined. Any advice would be appreciated.
