We are a townhouse community in NJ with a pool. Pool use requires us to purchase a pool pass and allows children 12 and over to attend the pool without an adult. Last year we had an incident where a child was permitted to lie about her age and come to the pool for 1 and 1/2 months without an adult. Eventually enough people complained to the board because we had all been required to wait for our children to be 12 and we considered it extremely unfair that this was allowed to continue despite repeated reports of her being underaged to the both the lifeguards and the board members. She would not turn 12 until the end of September. Another young man was punished for merely coming into the pool area to see if there was an adult that was able to be responsible for him while he swam. This is permitted as long as a notice is signed in front of the lifeguards that you are responsible for that child. This young man was banned from the pool for 2 weeks despite the fact that he would turn 12 in one week. We all think it is unfair that the child was not only permitted to lie about her age but was actually encouraged by a lack of punishment for putting the community at risk for a lawsuit if something had happened to her. Would it be fair if we asked the board to restrict her from the pool this summer for the length of time she was permitted to lie ? What are your thoughts on this? This is not sour grapes as I was not involved because my kids have been of age for awhile but I do feel bad for the young man that was not permitted to swim and was actually punished.
