Buyers denied mortgage because of ongoing condo association lawsuit

Question:

Our condo association has an on going lawsuit they filed against a contractor.  Because of the lawsuit instigated by the condo association potential buyers have been denied a mortgage.  Does the owner (seller) have any recourse against the condo association?
