Can condo board approve capital projects without 75% vote?


Question:

Our Board has issued the following statement; "In circumstances where the appearance of the building is altered in the course of a maintenance project to address safety, the building code, health concerns or to take advantage improvements in available technology of the better engineered products or remedy a design or construction defect, a 75% vote of the unit owners in not required". Is this statement true? If so, how do they prove any or all if the extenuating circumstances?  Pompano Beach, FL
