Cracked floor, who should pay for repairs?

My Brother in Law has a condo on the second floor of the building. He has a screened in Lanai with a cement floor. The floor has a long crack that was found under the carpet and it has leaked through to the unit below. The crack has been repaired before but who is unknown. Is it my brother in laws responsibility to pay and fix the crack or the associations. I think it is a structural issue and should be the associations responsibility.
