Do condo accommodations for former disabled Michigan resident need removal?


Question:

Disabled owner passed away. His roommate and current resident refuse to remove his larger tyvek porch deck installed to accommodate his wheelchair. This is different than all other porches. She is not disabled. Bylaws and deed just cite Michigan condo 59 which says one must remove handicapped accommodation with in 1 year of disabled’s departure. She argues that because the condo was built with the accommodations she doesn’t have to remove them. She states there are other accommodations inside but we are only addressing the outside of her condo. She has nothing granting her any permanent accommodation for this. What’s the fix?  Clarkston MI
