How to handle owner's HOA violation?

Question:

I responded to the Board Meeting's opportunity to answer via written statement, they never responded but left the violation open for over a year.  Now the HOA sent a final notice, another Board hearing and is threatening their right to fine under NC General Statue 47F. Is this legal
