Legal consequences of trustee terms expired and no new election

Question:

This question is submitted by Mary S. out of Massachusetts

I live in Massachusetts in a 55-unit condominium. We have all been through the pandemic and its restrictions. I want to know what the legal consequences are when trustee terms expire but there is no new election, and they continue in office. Following the partial collapse in Surfside, FL we hired a structural engineer and have begun contracted maintenance at substantial cost.

Are there any consequences to these signed agreements? Any repercussions? I am not presuming bad faith. I am trying to be legally protective. Does anyone know anything? We are not self-managed. We have a Management Company.
