New owner refuses to pay association fee


Question:

A new owner moved in and refuses to pay the new owner fee of $1,000. It has been collected from new owners since 1986 with no problems. The original fee was stated only in the original "Offering" but not in CCRs or bylaws; its increase to $1,000 was voted on and passed and in the minutes. The President says he forgot to tell this buyer about the fee and the seller also forgot to disclose to the buyer. Is the new owner responsible for this payment? The HOA is small and is located in NY.
