Parking permit required. Should HOA have towed my car?

Question:

I had a vehicle towed from my association for no parking permit. I reviewed the CC&R's and Rules and Regulations. No where does it state a parking permit is required. I am asking the HOA for reimbursement of my tows fees. They are stating because there is a sign as you enter the property stating a permit is required that the tow was legal and I would not be reimbursed. I provided them with Civil Code Section 4350 requiring the rule to be in writing. Is there any case law regarding this matter and is my HOA in violation?
