Rental restriction in Rockford Illinois - will hardship clause work?


Question:

rental-restrictionsI own a condo in Illinois. The HOA rules are no renters at all.

I moved out of the condo a year ago because I got married and the condo was not big enough for two people. I allowed my sister in law to move and advised a board member of this.

He said it should not create waves and likely would be hard to enforce due to the connection of being family.

My sister in law is now moving out in 3 months.

I called my realtor this morning, and was informed there would be no way we could sell the condo with out a $20,000 loss at minimum.

My condo docs have a hardship clause in them and I was wondering if anyone has knowledge on this clause and how it can be used? Would this case work? I wouldn't mind if the board wanted to give my tenant an orientation or even an interview of sorts.
