Should developer carry costs for unsold units?

Question:

We are a small HOA, only 12 units but room for 4-6 more to be built. Question is the developer puts up the units, then pays no HOA fee until they are bought. At that time the new owner starts to pay the HOA fee. Is this legal in Illinois? Some of us feel he should have been paying for the units as they sat empty as he owned them and our HOA fee paid for the yards care, etc. on his units.
