The HOA insists that the guardrails are the owner's financial responsibility


Question:

This question is submitted by David C. out of Oregon

I have a 3 story townhouse with a flat roof in California. The Condenser on the HVAC system went out. To replace the Condenser, a Permit is required. 


To provide a Permit, the City is requiring Guardrails to sit on top of the existing Parapets to meet the current Building Codes that require 42" height instead of the 31" height that was required when the building was built in 1997. 


HOA is insisting that the Guardrails are my financial responsibility even though the Building Code requirement applies to everyone. Please give me some advice.
