I live in Florida in a townhome. My water pipe has been broken 3 times for the last 8 years, and I fixed it. Right now, it is broken again, the OUC guy brought to my attention that the oak tree in a common area near the pipes is causing this.
Do I have the right to request the HOA to pay for the damage and remove the tree? There are several oak trees throughout the subdivision. CC&RS states that the HOA is responsible for what they call "Common Elements". I send them an e-mail and make them realize that the tree is causing and they are responsible for the damage.
Thoughts?
