Town house has cracks, drainage and water damage, who is responsible?

I moved into a town house in winter. I have cracks in my plaster walls, some w/ chips hanging from them. There is a Large crack thru the center of the concrete slab, it's > 1/8 in (its 1/2") and the edges are Uneven. There is OBVIOUS water, drainage issues due to the low location of the building and not much for drainage routes away from the slab. There are NO GUTTERS. and the trees close to the building have raised the ground so that the water flows towards the slab and not away as is conventional water management. Who is responsible ? For the cracks and the drainage problems.
