We over-assessed our condo owners.  Can we get our refund?

Question:

We had a special assessment over a year ago. All but one of the owners paid it and I am told that the Association/management company is going after him. We were told that we were over assessed and that each unit owner is due a $194 refund but we area being told that the unit owners can not get the refund until the one outstanding unit owner has paid up and until he does this we can not get back our refund. Is this true ? Do we have to wait or should each unit be able to get their refund?
