Who is responsible for fixing cracked concrete foundation in unit?

I bought a condo on the third floor of my complex and the concrete foundation is completely cracked and moved when you walk on it. I think because the concrete is part of the structure of the building it is the associations responsibility to fix the concrete but my husband was told we are responsible. So my question is who is responsible to fix this issue? Topeka Kansas
