Question:
Our management company says we cannot place a lien on a property for unpaid fines, only for unpaid dues.
Does anyone know the law on this? If we can't place a lien we have no ability to make unit owners pay fines. They can just walk away from fines if they sell.
Our issue is a unit owner renting out his unit through Airbnb, which is against our CC&Rs. Do we have any recourse?
