Can't close hurricane shutters due to neighbors!

Live in 3 story condo and recently the association had hurricane shutters installed. The snowbird unit above me is refusing to let us close them in the event of a hurricane. Our docs say in an emergency the Board has right of entry. I asked all the snowbirds to remove their screens before they headed north and that the association would not be responsible for any damage if we had to remove them but the unit above me did not. Thoughts?
