Is condo board fine justified?


Question:

We were having repair work done to the roof of our condominium building in Brooklyn. One of our tenants went up to the roof and walked around for less than 5 minutes before realizing there was work being done and they left. There was no sign or notice of the roof being closed other than an email that was sent to owners months before the tenant went to the roof. They were caught on video tape and the board imposed a fine of $500 for violation of house rules. Is this legal? Do we have any recourse? The board refuses to amend the fine or even consider our argument that there was no sign posted and the entrance to the roof indicating the roof was closed.
