Leaking between 2 units - who is responsible?


Question:

bad-condo-neighbor.jpgI live in Chicago. A unit owner under me is experiencing water leaking in the walls of one her bedrooms. Our units are identical.

On the opposite side of her wall is my refrigerator, cabinets and stove. I have had 2 professionals look in back of my refrigerator for water leaks. There was nothing.

In order to do more investigation, it would require me to remove rows of cabinets. The wall of the bedroom is the better option which is only drywall. This problem has been going on for almost a year.

I am concerned about the problem, and would like to get to the bottom of this because there could be a mold problem as well. The owner does not want the wall to be opened. What can be done legally? Since the water is in the walls, would the HOA be responsible? Would they pay for the whole job, like fixing her wall back up?
