New York condo board governance scares owners


Question:

Our Association which I am currently but not for very long on the Board is 17 years old. We have had no government for a good part of that time and people have done very much what they have wanted to do. We cover two private streets with money that was sporadically collected but that is at an all time low. I live on a city street which is attached to the Association when the Corporation was formed. We get no amenities except insurance. Since it is a city street garbage and snow removal is taken care of by city sanitation. We mainly pay dues to pay for the private streets. The home owners on the private streets benefit from the dues and yet they are the ones we take to court to try and collect dues. Also on the private streets they refuse to obey the fire department codes of no on street parking due to the fact that the streets are only 30 feet wide. New York law states that streets need to be 38 feet wide for on street parking and a proper circumference for a turn around for emergency vehicles which we lack also. We owe several years of Corporate taxes and our bills for lawyers, snow removal and insurance have depleted our funds. I stayed on the Board to try and straighten this mess out and also I am afraid of liability against my home. Others do not share this concern and they are now going to have an illegal vote to get the present board out and we don't know what they have in mind. Even our attorney says he is recusing himself from further involvement with this association since he sees the rapid decline. We have hired a new management company to help, but were told that they will be fired as soon as the new board takes over. They have the quorum to do so since they sent out a petition. These homeowners are clueless in how to run an Association and I see fines and violations down the path that will affect all of us from the Fire Department. We have been warned numerous times by both fire and the Community Board to get our act together. I have tried but it is useless. Many think that if the Association goes down that is the end of it and they could continue to do whatever they please again. They are so wrong on many levels and all will suffer the huge amounts of fines.
