NJ HOA's builder is preventing transition and renting out units


Question:

builder_vs_ownersOur HOA consists of a total of 170 dwellings within 6 buildings that began to be sold in 2004.

One of the 6 buildings (30 dwellings) remains to be built. The builder still owns and rents about 60 of the 140 built dwellings.

The builder is preventing transition from occurring as the builder still owns about 50% of the units, though it is making no effort to sell them and is simply renting them.

Does the HOA have legal recourse to force transition so that building defects can begin to be addressed with transition?
