Owners want to see details of suit against HOA


Question:

hoa-lawsuit.jpgAre owners supposed to have access to info about lawsuits against the HOA? The HOA provided very limited info that we were sued and the cases settled.

I looked for court records, but could not find any, so I assume it was settled out of court. They will not tell us what the lawsuit was about and what the settlement was. There is no mention of a non disclosure agreement.

We knew nothing about it until it was settled and we were slapped with a special assessment to pay what insurance didn't cover and legal fees.

Most owners assume the HOA was actually at fault as there are numerous known issues of gross misconduct on the parts of the HOA and maintenance staff.

My guess if the owners knew about the suit before it was settled, many would have provided evidence against the HOA.
