Question on board liability for offended homeowner


Question:

offended-condo-owner.jpgA letter was sent out by someone who attended a monthly HOA meeting that stated issues about the board members and the way they reacted to each other.

A homeowner who was present at this board meeting received this letter, and now assumes the letter was about them. They were hurt by the statements in the letter.

3 of the 5 board members voted to send an apology letter to this owner. The name of the owner was never mentioned in the letter.

Does this issue, by these 3 members, put the HOA at risk of liability by acknowledging responsibility?
