Restoration of balconies may change size of units


Question:

I live in a condominium with patio units, balcony units and no balcony or patio units. Our balconies were deemed unusable. The board wanted to send out a vote to determine if full replacement, smaller replacement or eliminate the balconies entirely. We were told by the association attorney that full replacement was the only option. The reasoning was it would affect the square footage of each unit therefore changing the percentage for the HOA fee. I had the understanding that balconies aren't included in the square footage for my unit, therefore I shouldn't be paying HOA on a balcony.  Also, only balcony owners are being assessed.  I feel at least the patio owners should be.
