Soil outside saturated due to over-watering and heavy rain


Question:

This question is submitted by Stewart M. out of California

 

I have a ground-floor condo unit with water damage in my exterior walls (interior drywall and wood flooring) which I believe is due to the soil outside my unit being overly saturated due to over-watering and heavy rain. And my condo HOA has not properly diverted the water away from the building. 

Is the HOA responsible for repairing my damage?
