How to update CC&R's to address water damage to common areas?


Question:

Our (California) association’s CC&Rs are silent with regard to damages caused by a homeowner’s failed interior component that causes damage to any other unit or to the common area. If it cannot be proved that the incident is due to negligence by the owner/tenant, then the owner’s insurance will not pay for damages. A water leak that originated inside a unit caused water damage to another unit. This incident is being classified as a “sudden water” accident (burst pipe). The property manager recommends that our CCR's be updated to cover such situations. Can anyone recommend a source for appropriate language?
