Can association be liable for not providing air conditioning repairs?

Question:

We have over 100 units in our HOA. All are central air. Some owners are putting in window a/c which is against our rules. They will be fined every month. My question is about liability. If the owner takes out the window a/c but does not repair their central air, is the HOA liable for any health problems a tenant may incur from heat? Can the owner blame the HOA for making him take out window a/c?
