Condo neighbor refuses to pay for water damages

Upstairs neighbors tub has a leaking drain. She at first agreed to pay all expenses. Now I had to contact my homeowners insurance and she has made no attempt to fix the leak and I have ceiling coming down in my bathroom and mold on the beams. I had a plumber come out to diagnose the problem he cut out part of the ceiling to take a look. No further action has been taken, she will send messages to fix it then nothing. The HOA refuses help they just send her emails to take care of it.  Denver, CO
