The contractor clogged the water heater from igniting

As a condo owner, I had no hot water or heat. I had a heater repaired but it would not ignite. I bought a new heater and it would not ignite as well. It turns out a contractor hired by the management to check a water leak in my home put some elbow in my water heater vent outside the building that clogged my water heater from igniting.
 
The HVAC tech found the issue and removed the elbow that the contractor installed and my hot water came back. I am suing the contractor for the price of the new heater. Who is responsible for this? Association, management, contractor, or me?
